Tsirat G. Enforcement of the foreign awards.

The dissertation is devoted to research of an institute of the enforcement o the foreign awards, including the detailed analysis of the bases for the refusal in the enforcement. Considering close connection of the award with the arbitral agreement, on the basis of which such award was issued, the author investigated in details the nature of the arbitration agreement and terms of its validity. The institute of setting aside of the award as a condition for the reusal o the enforcement is investigated in the work. The research of materials is cinducted of the basis of the international conventions, domestic laws of Ukraine, Russia federation, Germany, England. In work the author has stated the received theoretical conclusions and has offered the recommendations for their further use at the draft of a special legislation on enforcement of the foreign awards in Ukraine.
