The dissertation is dedicated to the discovery of the proceeding in administrative legal relation as a structural component of civil procedure and to the problems of judicial protection of citizen's rights against the sphere of governmental activity. In this work the ways and directions of the enhancement of legal theory and legislation in force in this branch are determined, the pre - conditions of the right to appeal to the court in this category of cases, the procedure of its realization and the peculiarities of court examination of the cases according to the complaints of citizens.
