Kuz'mina S. Protection of Interest of Managing Subjects from a Unfair Competition

The subject of research: set of legal means, which represent the mechanism directed toward prevention of occurrence of unfair actions in the competitive relations. The object purpose of research: the legal analysis of the domestic and foreign antimonopoly-competitive legislation, and also analysis of practice of application of ways of prevention and termination of a unfair competition in economic activity; elaboration of practical recommendations for improvement of the antimonopoly-competitive legislation of Ukraine on the basis of results received during realization of research. Methods of research and equipment: a dialectic method of knowledge with application of scientific methods of the theoretical, formal-logic, system, structural-functional, normative and comparative analysis. Theoretical and practical results: the practical recommendations for improvement of the national antimonopoly-competitive legislation which were used in the project of the Economic (Commercial) code of Ukraine (Chapter 6. " Development of an economic competition and restriction of monopoly") are developed. The elaboration of the author can be used: by preparation of departmental normative materials and practical measures directed toward termination of unfair competitive actions during economic activity; by the students and teachers of legal and economic high schools during realization of research works and in educational process course "The antimonopoly-competitive right " and special course "Protection against a unfair competition". Novelty: complex research devoted to problems of realization of the mechanism of protection of interests of the subjects of managing from a unfair competition for the first time is executed; the place and role of the competitive right in the economic right of Ukraine, its interrelation with the antimonopoly right of Ukraine are proved; forms and ways of protection of interests of the subjects of managing from a unfair competition specific for the competitive right of Ukraine are determined; the mech anism of protection of interests of the managing subjects from a unfair competition is concretized and specified; the changes and additions to the working antimonopoly-competitive legislation of Ukraine are brought in; the directions of increase of efficiency of application of the national antimonopoly-competitive legislation are determined.
