Shtefan O. Claim procedure in cases on author's and adjacent rights by way of civil legal proceedings of Ukraine

Thesis deal with research problems of modern and perspective development of civil legal claim proceedings on protection of disputed and violated author's and adjacent rights. Claim as a proceeding of bringing civil lawsuit on the protection of author's and adjacent right is defined in the dissertation. Raising a claim as a subjective civil procedural right, its subjects, circumstances and procedural order of its realization are characterize as well. Parties of author's and adjacent case law, its types and peculiarities are defined in the thesis. The preparing peculiarities for court examination, proofs and court decision on author's and adjacent legal relation cases are analysed. Some theoretical conclusions and practical advices on the researched questions are made in the work. They are directed to perfect legal relations of civil procedural mechanism of the protection of author's and adjacent rights by means of civil proceeding claim.
