Shcherbyna O. Legal Status of Shareholders under Ukrainian law

The dissertation contains analysis of theoretical and practical issues connected with regulation of the legal status of shareholders in Ukraine. The dissertation explores the legal nature of shareholders' rights and obligations, corporate legal relations, grounds for their rise and termination. The fundamental tenets of the theory of corporate legal relations are developed and formulated. The main rights of shareholders, in particular the right to participate in the company's management, to receive dividents and to obtain information on the company's activity, are analyzed. The statement that the obligations established by Article 11 of the Law of Ukraine "On Business Companies" are not specific for realization and guaranteeing the protection of rights and interestsn of shareholders are introduced. Special attention is the development of specific practical recommendations for the improvement of the Ukrainian legislation and its implementation practices.
