Pogribnyj S. Comparative Analysis of the Institution of Possession in Continental, Anglo-Saxon and Eastern-European Systems of Law

The dissertation is devoted to analysis of the Institution of Possession, basic theories and doctrines in this field of law in ancient Rome, some foreign countries, which representative Western and Eastern tradition of private Law and in Ukraine. Author pursues an object to be determined in construction of own model of the Institution of Possession. This model must correspond to world standards and Ukrainian traditions, must be introduced to the Ukrainian system of civil law as its Institution. Basic elements of the Institution of Possession (concept, maintenance, kinds, defence et.) are represented in development and comparison with various conceptions of regulations of this Institution in systems of law. As a result of the research the author worked out proposals to be taken into account in the process of Ukrainian Institution of Possession law reform. Also they can form a new doctrine of the Institution of Possession to be implemented in Ukraine.
