Shevchuk L. The Will as the Grounds for Origin of Legal Succession in Civil Law of Ukraine

The dissertation deals with the problem of the will as the grounds for origin of legal succession in civil law of Ukraine. The category of inheritance by the will as a specific type of legal succession in civil law has been determined. The major signs of the object of legal succession when inheriting by the will have been defined. The concept and types of legal succession when inheriting by the will have been stated. The problem of the grounds of legal succession when inheriting by the will has been analysed. On the basis of theoretical and judical analysis of the specific signs of the will the concept of the will has been formulated and its judicial characteristic has been performed. The legal characteristics of testamentary renunciation as the grounds of singulary legal succession in inheritance law has been given. The proposals as for legislation improvement in the sphere of relationship regulation when inheriting by the will have been worked out.
