Grynyuk R. Legal Status of Communal Businesses in Ukraine

Object of research: set of the economic relations, which arises during creation and functioning of the communal businesses. The purpose of research: definition of a place of the municipal enterprises in system of the subjects of managing, revealing of features of their legal status and development of the offers and recommendations directed on improvement of the current legislation of Ukraine about the communal businesses. Methods of research and equipment: the scientific-historical analysis, formal-logic, dialectic, methods of the analysis and synthesis, system-structural, comparative-legal. The theoretical and practical meaning of research consists that it can be used in the subsequent scientific elaborations concerning improvement of regulation of activity of the communal businesses in Ukraine, and also in practice of activity of the communal businesses, organization of management by them; For improvement of the current legislation, definition of ways, ways of creation and legal form of the enterpris es based on a communal property. On the basis of research a number of topics of an educational course "the Communal right of Ukraine" and special course "Legal bases of management of the communal property", and also methodical maintenance to them are elaborated. The scientific novelty of the received results is defined by that for the first time the features of the legal status of the communal businesses in new economic conditions are investigated, the concepts of the communal businesses as subject of economic activity are theoretically proved and formulated, its features are determined. Main for the legal status of the communal businesses definitions of "Communal businesses", of "special subject of law", of "the unitary enterprise" are advanced. The necessity of modification and additions to the current legislation is proved, and also the offers concerning the project of the law "About the right of the communal property" are developed. Sphere of use are law-making bodies of the central authority, the bodie s of local self-management; higher educational institutions.
