Essay

The thesis is dedicated to the investigation of the legal nature of the agreement on oil delivery in the conditions of market relations and the problems of the legal regulation of the relations in the process of its conclusions and fulfillment. The investigation of the legal process of oil delivery is carried out on the basis of the analysis of the social, technical and economic intercommunications of the different persons taking part in oil delivery and its processing. The specific character of the ensuring of oil delivery consists of different relations appearing in the process of delivery. This process is interconnected and includes all kinds of relations on different stages from its prospect, extraction up to its processing and consumption of light products. The determination of oil as the particular kind of commodity is made; the systematic analysis of the agreement on oil deliveries as independent kind of bargain on assignation of the property rights on oil carried out. The distinctive characteri stics of the agreement on oil delivery which distinguish it from other similar civil legal agreements are formulated. The bases on the necessity of the application of the additional measures to enhance the property responsibilities between the subjects of the agreement on oil delivery are given. The investigation of the working model of price formation and price regulation on oil and the products of its processing is made. The activity of the mediatory patterns on the oil market is analysed. The necessity of the quickest adoption of the Ukrainian Law on oil and gas is substantiated.
