Thesis is dedicated to researching procedure particularities of trial by court and resolving matters for recovery of property out of arrest. The analysis of problems of correlation and using of common and special legal norms and also of influence of character of material legal relations on particularities of trial by court and solving civil cases. The items of research an connected with the definition of jurisdiction according to the matters of property's recovery of the arrest, with particularities of participations of the parts and third persons, provement and evidences violation, preparing trial by a court and delivery concearning the categories of cases. It is worked out science-foundated propositions about aprovement of institute of trialing by a court according to recovering of possesions out of the punishment.
