Essay

The thesis is devoted to the issues of the delay of treaty obligation fulfillment. This paper analyzes historical aspects of such delays and studies problems of time terms in civil law, their correlation with delays and their place among juridical facts. Debtor's and creditor's delays are analyzed as independent types of delay. Debtor's delay is described along with the accompanying juridical facts and the consequences. The conclusion is made that the major consequence of the delay is the civil law amenability of the debtor. Such responsibility as paying damage and forfeit is considered the general consequence of the delay, whereas paying interest and compensation of the losses connected with inflation are considered the special consequences. Characteristics of financial obligations are studied in detail; their definition and classification is suggested. The notion, characteristics and consequences of creditor's delay are analyzed. General and special consequences of creditor's delay are described.
