Dissertation is dedicated to the research of legal support problems of orphans and children deprived of parental care sustain and upbringing in Ukraine. Aiming at solving these problems the historical experience of Ukraine and nowadays foreign practice were considered in resolving this issue, as well the acting legal base in this area was analyzed. The objective advantages of family legal forms of orphans and children deprived of parental care sustain and upbringing comparing these children' upbringing in the state institutional systems of care were theoretically grounded. Non-correspondence of acting institutional system of care to the UN Convention on children rights norms to the child needs and interests was defined. By the results of the research the ways of legal support of orphans and children deprived of parental care sustain and upbringing mechanism improvement were introduced. Special attention was paid to such forms of family sustain and upbringing of mentioned children as foster family and family-type home.
