Nikiforak V. The Liability Insurance Contract.

The dissertation is the independent completed scientific work, first in Ukraine complex research of the agreement of the liability insurance contract. On the basis of the current legislation the features of civil responsibility as object of insurance are analyzed. The legal bonds between the insured accident and composition of tort come to light. On the basis of the legal-theoretic analysis of particular features of the liability insurance contract, its concept is formulated. The essential conditions of contract are object, subject, insured accidents, liability limit of the insurer, size of insurance payment and term of the contract. Also the author gives the detailed characteristic to the parties of the liability insurance contract. The special attention is given to participation in the insurance obligation of the third persons. In the dissertation the classification of kinds of the liability insurance contract is conducted. Besides, the author researches the gapes and conflicts of the Ukrainian legislation in the field of liability insurance and proposes the ways of proving of current legislation.
