The dissertation is dedicated to the research of means and procedural forms of protection as structural components of civil rights protection institute. The author states that civil rights protection institute is complex and in-terdisciplinary event for the legal science, which has material-legal and pro-cedural aspects. The analysis of the essence of right for legal protection taking into account justice availability standards is conducted. The author researches means of judicial realization of civil rights: claim and court decision. The concept of the lawful power of court decision and its legitimacy is stated. The proposals concerning improvement of civil procedural legislation are made.
