Essay

Object of research: procedural relations connected with proving in economic legal procedure and using of evidences. The purpose of research: to find decisions of problems of applying evidences in economic legal procedure. Research reception: modern methods of knowledge: of the analysis and generalization, of the sociological researches, formal-logic, system-structural, comparative-legal, methods of the statistical and historical analysis. The theoretical and practical meaning consists in defining such notions as 'proving' and 'evidences'; creation of classification of evidences in economic legal procedure; determinition of features of 'admissibility' in economic legal procedure; improvement of such notions as 'written evidences', 'material evidences'; making proposals to admit witnesses, specialists and auditors to economic procedure. On the basis of the analysis of rules of proving of economic legal procedure the recommendations concerning perfection of the national legislation are developed. The results of research are used by preparation of the offers for the Code of Economic Procedure of Ukraine. On the basis of research a number of subject of an educational course "Law of Economic Procedure" and special course "Proving in procedure" is developed. The scientific novelty of the received results consists in determination for the first time of specifical features of proving and evidences in economic procedure of Ukraine in the light of general theory of proving and evidences, and in comparison with proving and evidences in criminal and civil procedure of Ukraine. Sphere of use are law-making bodies of the central authority; subject of economic activity; economic courts; higher educational institutions.
