Sichevlyuk V. The investment agreements on a housing construction (civil-law aspect)

The thesis is devoted to the research of urgent theoretical and practical problems tied with the regulation of the investment agreements on a housing construction. The author of the thesis investigates civil law methods of regulation of public relations in the above mentioned sphere, analyzes the legal status of their participants; the essence and legal nature of the investment agreements, the peculiarities of the investment agreements on a housing construction and shows their difference from such kinds of the civil law agreements as sales and purchases, contract, joint activities (share participation). On this foundation the author gives his own definition of the concept of the investment agreements on a housing construction, its essential conditions, rights and responsibilities of the parties, for responsibility violations or inadequate fulfillment of the obligations. The author has made the conclusions and proposals on the improvement of legislative regulation of relations arising in the sphere of action of the investment agreements on a housing construction, in particular the author substantiates the necessity of the Law of Ukraine "On an investment housing construction".
