The thesis makes a compound research of genesis of general average and the tendency of development this institute; the branch fitting the institute of general average is determined; concept and tags of general average on an international private marine and national marine law of Ukraine are esteemed; their value and intercoupling are characterized; the features of distribution of general average losses and problems arising at civil law are established; the tags and allocation units of general average are analyzed, as the civil matters; attitudes arising at distribution of general average are esteemed, and their nature is determined, as civil-law obligations; the demarcation of general average and other civil-law institutes is carried out; place of institute of general average in a system of the Civil Law of Ukraine is determined; optimum civil concept of institute of general average and possible tendencies of perfecting of civil law procedure is determined.
