Milash V. Legal features of a protective clause a condition in the foreign economic contract

The dissertation is devoted to the research related to legal features of a protective clause as a condition in a foreign economic contract. The work defines that there are such features as: functional purpose and legal technique of working out the specified contractual condition and also qualifying characteristics of the circumstances which introduce them into operation. The thesis carries out the detailed characteristics of the above mentioned features and gives the appropriate definitions. The protective clauses existing in the international commercial turnover are reduced in a uniform classification, as well as the legal status of the given condition in the contents of a foreign economic contract is defined. The protective clauses mostly widespread in the contractual sphere (e.g. Acts of God clause, complicating circumstances and clauses of adapted - price character ) are studied. The dissertation formulates the concrete propositions on the improvement of the current legislation in the sphere of making of foreign economic contracts.
