Lyzogub Y. The criminal responsibility for Trade in Human Beings or Other Illegal Transaction Concerning Transfer of Human Being: comparatively-lawful research.

The dissertation represents the first in Ukraine scientific research of a criminal-law protection of the freedom and inviolability of a human being in a comparatively-lawful context using the example of the legal analysis of the article 149 of the Criminal Code of Ukraine 2001 - "Trade in Human Beings or Other Illegal Transaction Concerning Transfer of a Human Being". Concepts "human rights to freedom", "human rights to personal in-violability", "trade in human beings", "the purchase of a human being", "sale of a human being", "other paid transfer of a human being", "other paid receiving of a human being", "effectuation of any other illegal transaction concerning other human being". The contents of the generic and immediate objects of this crime are opened, features of the objective and subjective sides of the structure of people trading and also the subject of the given crime are displayed. Qualificatory attributes of "white slavery" are investigated here. The sphere of criminal-law measures of the influence regarding individuals who are engaged in trade in human beings is defined. The contents of forms of the participation in the effectuation of the examined crime is reviewed. The practical recommendations concerning correct enforcement of the art. 149 of the Criminal Code of Ukraine are formulated, also propo-sitions concerning improvement of the article are advanced, besides own version of this norm is proposed.
