Donchenko Y. Bail as a Preventive Measure in the Criminal Procedure of Ukraine.

The thesis is dedicated to the issue of bail's application under Ukraine's law of criminal procedure. Within the theoretical aspect of the research a notion of "measures of proceeding compulsion" is analysed; both practical and theoretical importance is elucidated; in the interaction, the place and role of preventive measures, including bail are examined. The indicated objects are considered in a new aspect of human rights priority with international humanitarian law taking into account. A form of bail object is analysed, approach concerning the determination of property amount which shall be bailed, is singled out, the range of potential pledges and their procedural status are determined. Recommendations of bail applying, altering, or challenging, processing of investigator's or judge's actions are worked up. The Thesis is concluded with the proposals aimed at improving legislation as well as investigation and court practice of procedures of bail's application.
