Bratel O. Civil Law Consequences of Emergency Situations.

The dissertation addresses topical issues of civil law regulation of consequences of emergency situations. Legal regulations in force and new civil legislation of Ukraine, which regulate issues of the influence of emergency situations on civil relations, are explored in this research. The definition and characteristics of such notions as "an acci-dent", "insuperable force" and "force majeure" have been determined in the context of their belonging to the civil law category of an emergency situation, the aspect model of civil law consequences of emergency situations has been proposed; principal civil remedies for protection of individuals' and legal entities' rights and interests infringed due to occurrence of emergency situations as well as peculiarities of recovery of damages caused by the radiation impact have been analyzed. The defined theoretical principles and practical recommendations which may be applied while elaborating legal acts and updating the Ukrainian legislation, which regulates consequences of emergency situations, are the results of this research.
