Nizhynska I. Damages, caused by unlawful actions of inquiry and pre-trial investigation in police of Ukraine

This thesis is dedіcated to the issues of damages, caused by unlawful actions of inquiry and pre-trial investigation in police. The unlawful actions of inquiry and pre-trial investigation formed the basis of the right on compensation. So, this constitutional norm is directed on the protection of the citizens of Ukraine, which were victims of police abuse. According to the Ukrainian Constitution, Civil Code & Law, every person, who is a victim of unlawful actions of inquiry and pre-trial investigation in police has a right on the financial and moral compensation for damages at the expense of the State budget.Presently the civil law of Ukraine pays much attention for the concept "moral damage", because it's an innovation in Ukrainian Law. There is no definition of "moral damage" in the Ukrainian legislation.
