Essay

The dissertation is devoted to the general-human principles of law, as a universal normative basis of positive law, elaborated by the humanity as a global macro-civilization system and that determine the essence and direction of legal regulation and can be applied by any legal system. Their own terminological status is substantiated and the delimitation between them and similar notions as for instance basic (cardinal) principles of international law, general principles of law, generally recognized principles of law is made. The notion is formulated, the signs and functions of the general-human principles of law are analyzed, and the contents of the general-human principles of equity, democracy, justice and principle of respect and defense of human rights are examined. The mechanism of implementation of the general-human principles of law in the national juridical practice, in particular in Ukrainian. are investigated in the dissertation.
