Venediktova I. Contract for Property Trustworthy Control as a Form of Legal Institution of Property Trustworthy Control Realization in Ukraine

Thesis is devoted to the research of a new contract type, which has been created in civil law of Ukraine, - contract for property trustworthy control foreshortened of its realization as a form of legal institution of property trustworthy control. Social, legal, and economic suppositions of this institution creation, the field of its application are considered in this work. Advantages and shortages of legal institution of property trustworthy control as for alternative constructions dealing with property control are defined by the way of a comparative analysis and the conclusion is made that property trustworthy control among these constructions is the most suitable for such legal relations' regulation. Author's notion of contract for property trustworthy control is proposed. Subject, contract's parties, their rights and responsibilities, legal consequences of contract conditions' nonfulfillment (improper fulfillment) and grounds for prescheduled cessation of contract's effect are revealed.
