Essay

Thesis is dedicated to researching of both subjective and objective factors and preconditions of the third persons' participation in the labour agreement cancellation with the certain categories of employees. A group of persons who are capable to demand or initiate the labour agreement cancellation, as well as their authorities, were determined. A classification was developed and objectives, that are followed while dismissal of employees occurs, initiated by the third persons' demand, were defined, as well as dismissed employees' guarantees. A conclusion on unreasonableness of trade unions' rights contraction regarding their control on following the Labour Legislation was proved. Trade Unions' activity has positive influence on economical efficiency and social justice. Proposals were made on including changes in some article of the Labour Law Code of Ukraine and other standard acts concerning the third persons' participation in abeyance of labour relations.
