Object - the legal relations, which arise in the process of professional activity the personnel of establishments of execution of punishment, first of all, in the time realization of correctional process, which direction on the attainment of purpose of execution of criminals punishments; purpose - on the basis analysis of legislation of Ukraine and practice to open organizationally-legal bases, peculiarity of formation and functioning of the personnel of establishments of execution of punishment and work out propositions on the improvement; methods - system analysis, structured-functional, history, relatively legal, sociological, statistical and logistical; novelty - the dissertation is one in a first research, in the nationality legal science, of organizationally-legal bases of formation and functioning of the personnel of establishments of execution of punishment at condition building of democracy, legal and social state; results - the thesis material may be used in the scientific, law creative, lawapplicable spheres and educational process.
