This dissertation dedicate problem of the appeal institute : it was investigate its historical development, juridical nature and meaning in the civil procedure; analyzed the currently law in force, the main problem of the juridical practice, pursued the comparative analyze of foreign law; investigated the essence, idea and problem of appeal; worked out the recommendation about the improvement of the legislative regulation and the mechanism of application as the way of appeal judgment the first instance and as the way to defense the right.
