Bilya I. The theoretical basis of the normmaking technigueacts

The dissertation devoted to the research of the theoretical basis of the normmaking technique usage. In this work the conception of the normmaking technique has been given; its relationship with the legal and law technique, normmaking technology conceptions has been established. The normmaking technique place as to the legal practice and at the system of the legal knowledge has been determined. Delimitation of the normmaking technique and the organizational-procedural rules, rules that regulate cognitive activity, rules of the normative-legal acts, planning of the normmaking activity has been carried out. The problems of the normmaking technique influence on the determination of the normative-legal acts content have been solved. It is given the characteristic of the logic, specially-legal, linguistic-stylistic rules and method of the normative-legal acts structuring. The main possible ways of the normmaking technique adoption in the practice of the normmaking activity in Ukraine has been discussed. Inthe dissertation the conceptual principles has been formulated and the new proposals and conclusions in connection with the investigated problems have been given grounds.
