Essay

The thesis deals with the investigation of genesis of the theory of separation of power and ways of its conceptual interpretation in a classical and modern political and legal science. The author defines the essence of this political and legal phenomenon, its meaning in the process of development democratic power and the state of law. The thesis examines the basic constitutional guarantees which allow to realize not only separation of powers between legislative, executive and judicial branches of authority, but also provide their effective interaction, and keep integrity in functioning of the state authority. Author analyses the characteristic features of realization of the theory of separation of power in transitive political systems, investigates the legal aspects of balance of power, basic legal institutes due to which the bodies of different branches of state authority have an opportunity to cooperate. The work presents the basic directions of criticism of the theory of separation of power come, and proposes such a model of this theory that allows to decrease a level conflicts between separate branches of power.
