Zhurick Y. The Cases of Violation of the Legislation related to Protection of Economic Competition and Consideration of the Cases the Antimonopoly Committee of Ukraine.

To achieve the aim of researching legal nature, the types of violation of the legislation related to protection of economic competition have been analyzed in the dissertation. They are the problems of legal status and the powers both of antimonopoly bodies of Ukraine and of officials of these bodies, who are authorized to consider the cases on violation of the legislation related to the protection of economic competition. As the result of researching, the author of the paper suggests a number of proposals related to defining and rendering concrete the status of Antimonopoly Committee of Ukraine. The main attention is paid to analyzing procedural order of consideration of the cases by the antimonopoly bodies of Ukraine starting with the moment when the claim is submitted and finishing with the order of executing a judgment. The progress of official inquiry when the cases are being considered, procedural terms, legal status of subjects, who take part in the consideration of the cases, the way of gettingand examining evidences, making decisions due to the results of the inquiry have been considered thoroughly. The number of cases considered by antimonopoly bodies of Ukraine, have been analyzed on the basis of practical materials. The research done by the author, result in formulating and submitting a number of proposals relating to the current legislation, particularly to improving the order of consideration of the cases related to the violation of the legislature on the protection of economic competition.
