Kushch L. Economical legal aspects of medicine production and trade

Object of research: the relations arising during organization and realization in Ukraine of production and trade by medical products as of kinds of economic activity. The purpose of research is the elaboration of theoretical and practical questions of economic-legal regulation of the relations, which arise during organization and realization of production and trade in medicinal products, preparation of the offers on perfection of the legislation, and also practice of its application. Methods of research: abstracting; comparative-legal; system-functional; statistical. Theoretical meaning of the received results: the level of theoretical elaboration of the given problem in a science of the economic right concerning improvement of legal regulation of production and trade by medical products is raised. Practical meaning: the concrete offers which can be used during completion of the project of the Law of Ukraine "About pharmaceutical activity", and also by preparation of the offers concerning modificationand additions in the working economic legislation are formulated. The results of work are used in practical activity of small joint venture "Medinterdent-service", in educational process at reading disciplines "The Economic right", "The Medical right" and "The Economic legislation". Scientific novelty: the definitions of concepts of medicine production, wholesale and retail trade in medical products are proved; the legislation on production and trade by medical products is systematized; the offers on its perfection are proved. The definitions of the subjects who are carrying out these kinds of activity are formulated; kinds and their organizational forms are determined; the features of their legal status are specified. The legal means of maintenance of state support, licensing of production and trade by medical products, pricing at their realization are concretized. The directions of perfection of legal regulation of questions of the responsibility for infraction of the legislation about production and tradeby medical products are offered. Sphere of use: the subjects of managing which is carrying out production and trade by medical products; the subjects of the legislative initiative; higher educational institutions.
