Frolov V. The juridical person and its realization on civil law of Ukraine (civil aspect).

The dissertation is devoted to a complex research of the questions of dealing competence of juridical persons and its realization in the civil law of Ukraine. For the first time at a monographic level the research of the concept and the implementation of such issue of juridical personality as dealing competence is made, which should be understood as the ability of a juridical person to accomplish operations directed on establishing, changing and concluding of the civil rights and obligations. The main purpose of the research is to define the concept of the dealing competence of the juridical person, finding out the nature and the meaning of it and also the peculiarities of its realization through the organs of the juridical person, usage of the institute of representatives in modern conditions. It is also important to define the peculiarities of making and executing such deals and their meaning as a ground for appeanng of the civil relations in the system of civil law of Ukraine, establishing the special features of realization of certain subjective rights and obligations of a juridical person. The tendency of widening of a dealing competence of juridical persons is observed and the peculiarities of its realization m concern to some kinds of such subjects of civil law are analyzed. The peculiarities of the realization of the dealing competence of the juridical person through its organs, members within the institute of representatives have been analyzed. The propositions on improvement of the civil law of Ukraine have been formulated."
