Borschevskiy I. The contract of lease (hire) of a real estate

The thesis is devoted to the problems of legal regulation of the relations arising in the process of conclusion, fulfillment and termination of leasing (hiring) legal agreements concerning a real estate. Particular attention is paid to the investigation of legal regulation of leasing (hiring) of the enterprise as a uniform property complex as well as to the analysis of relations arising between the parties of agreements of lease (hire) of the enterprise as a uniform property complex and its creditors; agreements of lease (hire) of buildings and other capital constructions and their parts. The author gives definitions of the principal features of buildings and capital construction essential for the legal regulation; illuminates civil law aspects of regulations of relations arising in accordance with agreements of lease (hire) of the land plots; determines peculiarities of agreements lease (hire) of dwellings and determines the rights of creditors of the enterprise during its transfer.
