Derevyanko B. The legal regulation of creation and activity of the industrial-financial groups

Object of research: the public attitudes arising during industrial-financial integration. The purpose of research is the elaboration of scientific rules and offers on perfection of legal regulation of creation and activity of industrial-financial groups (IFG). A method і of research: historical, dialectic, statistical, logic, comparative-legal, analytic-synthetic. The theoretical meaning consists in a deepening and perfection of a level of theoretical elaboration of questions of legal regulation of creation and activity of industrial - financial groups in a science of the commercial law. Practical meaning: the blanks and lacks of the current legislation of Ukraine about IFG are revealed, the concrete offers on their elimination are proved and formulated. The project of the Law of Ukraine "About modification and additions in the Law of Ukraine "About industrial-financial groups in Ukraine" and to some other acts of Ukraine" is elaborated which can be used in law-making activity. The conclusions of dissertation are used in educational process at teaching discipline "Commercial law ", at the conclusion of the agreements between the participant IFG by the Sumy state research institute of mineral fertilizers and pigments "MINIDIP" and SJK "Titan" with the purpose of realization of the Complex program of development of non-ferrous metallurgy of Ukraine. Scientific novelty: doctrinal concept IFG as industrial-financial association of the enterprises of the special kind, which is created and works on principles of the partner relations between the state and subjects of managing, is formulated. The legal definition of concept IFG is advanced. The stages of creation IFG are allocated, the ways of simplification about creation IFG are offered. The expediency of formation in the legislation of the requirement of creation of special funds IFG is proved. The definition of a legal nature of the IFG General agreement is advanced in view of its qualification as organizational economic contract. The basic principles of legal maintenance of state regulation of creation and activity IFG are systematized. Sphere of use are the subjects of the legislative initiative; the subjects of managing during creation and activity of industrial-financial group; higher educational institutions.
