Dzhumageldieva G. Legal regulation of price and price formation

The object of the research is the legal relations, that are arised at the establishment of the prices in a national economy. The purpose of the research is the substantiation of the general approach and the development of the concrete recommendations on improvement of legal regulation of price formation and of prices on the basis of the analysis of materials of economic practice and generalization of results of theoretical researches. The methods of the research are the historical, the rather and legal, the analytical and synthetical, the formal and logical, the statistical. The theoretical meaning raises considerably a level of theoretical development of questions of legal price control and price formation in the Ukraine in a science of the economic right. The practical meaning consists in an opportunity of use of theoretical rules and conclusions in low formation activity with the purpose of improvement of the legislation of the Ukraine about price formation. The rules of the work were used during economic activity by the definition of the price on coal and coal production of Leasing Enterprise Zasyadko mine, by the development of directions of price policy of PC Donetsk metal works. The rules of the research have allowed essentially to improve the order price formation at the State enterprise Snezhnoeantratsit. They are used in educational process at the teaching disciplines Economic low, Trade low, and Commercial law in the Donetsk Institute of Interregional Academy of Management of the Personnel. The scientific novelty: the necessity of the system approach to the price legislation about price formation is proved. The role of the price as an essential condition of the contract is proved and the offers concerning a concrete definition of ways of its definition are made. The expediency of a cancellation price preferentions for the national manufacturer is argued at definition tender's prices. The offers on harmonization tax and book keeping are brought in at definition of the cost price of production. The necessity of distribution of the general order of formation of the cost price on the tariffs in sphere railroad transportation by railway is argued. The necessity of structural reform of the system for management of price formation is proved. Proposals are made to unity sanctions which are applied to the price legislation breakers by State cost inspection and Antitrust committee. The spheres of use are the subjects of the legislative initiative, the subjects of managing during realization of economic activity, and higher educational institutions.
