The thesis is devoted to research into peculiarities of the judicial review doctrine as the power of the courts to rule on constitutionality of executive and legislative acts. The following issues are highlighted: definition of the content of the "US constitutional justice", peculiarities of the US legal system, foundation and evolution of the judicial review doctrine and case law and separation of powers doctrines, the role of the legal rule interpretative precedent in the activity of the Constitutional Court of Ukraine, the role of dissenting or concurring opinions of judges, forms and limits of constitutional interpretation by the United States Supreme Court, the role of the United States Supreme Court in the human rights protection mechanism.
