Fedchenko V. Crimes inquiry with investigative and investigative-operative groups: legal and organizational basis.

Об'єкт дослідження - of such phenomenon as criminal procedure legal relationships that arose in the process of crime investigation by operative subdivision's staff. Мета дослідження - is to outline and analyze the framework of legal and organizational principles of crime investigation by operative subdivision's staff. Методи дослідженя - legal, systemic analysis, structural, formal-logical, sociological. Наукова новизна - of the work is in the determination of the legal principles of crime investigation by operative subdivision's staff. Практичне значення - in the research is laid on the elaboration of procedure measures system that can guarantee each participant of the criminal process the possibility of application the whole range of procedure rights provided by the law during the process of investigation of the abovementioned staff. The practical value of the work is the theoretical conclusions and practical recommendations formulated as for the further improvement of the criminal procedure legislation and departmental normative acts in the sphere of investigation of complicated and large criminal cases. The principles and conclusions presented in the dissertation are being used in: а) legislative work to amend and supplement the current Criminal Procedural Code of Ukraine and the project of the new Criminal Procedural Code of Ukraine; b) practical activity of the pretrial investigation and public prosecutor's office; c) in the teaching process during learning of the corresponding topics of the criminal procedure by cadets and students and practitioners from investigating authorities of internal affairs and public prosecutor's office while improving their skills. Предмет і ступінь впровадежння - after the results of the research the proposals for the Criminal Procedural Code of Ukraine in force and its project have been formulated and sent up to the Verhovna Rada (Parliament) of Ukraine Committee on legislative securing of law enforcement activity; to improve the effectiveness of investigative (investigative operational) groups' activity proposals like scientific articles have been sent up to the Office of Investigation of the Dnipropetrovs'k City Department of the Law Enforcement Agency of the MIA of Ukraine in Dnipropetrovs'k Region; the results of the dissertation are incorporated in teaching activity of the Criminal Procedure Department of the Ministry of Internal Affairs Law Academy. Ефективність впровадження - conclusions and proposals are positively evaluated by experts. Сфера використання - criminal procedural activity of preliminary investigation agencies of Ukraine, law-making and training process.
