Pashkov V. Legal regulation peculiarities of medicines turnover

The actual thesis is devoted to the research of legal aspects peculiarities of medicines turnover. From the author's point of view special attention has been paid to legal regulation aspects of medicines market. Primarily it is the problem of medicines indication as an object of property rights and legal procedure of their turnover. The stages of market relations regulation in this sphere have been presented. The thesis contains complex analysis of theoretical and practical problems dealing with legal ensuring of public relations realization in the sphere of medicines turnover. Classification of common and concretized public interests and mechanism of their realization in the process of legal regulation of economic relations has been carried out. The boundaries have been fixed between notions 'trade' and 'sale' of medicines. Special attention has been paid to the specification of economic contracts, used in the process of medicines sale. The author suggests essential conditions for conclusion of thesecontracts. On the basis of actual and perspective legislation of Ukraine as to the regulation of medicines turnover, Basic principles draft about content and order of medicine wholesale trade contract drawing up has been elaborated.
