Essay

The dissertation is devoted to complex civil law research of foreign investments legal regime in «Yavoriv» special economic zone (SEZ). The process of foreign investment development in SEZ is considered. The legal nature of SEZ and its signs are analyzed the notion of SEZ which is disclosed more thoroughly and completely is proposed for legislative confirmation. The classification of SEZ according to different criteria is made the expediency of exclusion off-shore zones as a rind of SEZ is grounded. The dissertation investigates the legal status of investment activity subjects in «Yavoriv» SEZ a range of persons which may be the subjects of «Yavoriv» SEZ is determined. An exclusion of separate structure subdivisions which have no juridical person status as they are not independed in legal relations is proposed. The civil law nature of agreement (contract) on investment project in «Yavoriv» SEZ is grounded a set of changes to legislative regulations of agreement relations in «Yavoriv» SEZ is proposed. The author investigates the peculiarities of foreign investments in «Yavoriv» SEZ, defines the legal regime of foreign investments in the zone, analyzing special procedure of foreign investments admission, realization state legal guarantees for realization of foreign investments in «Yavoriv» SEZ, the ways of defending rights and interests of foreign investors Especially in case of cessation of investment activities in «Yavoriv»SEZ are analyzed. Having analyzed the nature of foreign investigation institute some proposals to current legislation are made recommendations on their use in practice are elaborated."
