Gelets'ka I. Legal regulation of representative relations in civil law

The comparative – legal analysis of representation in regard to other forms of establishment and realization of civil legal relations among two or mere persons with the participation of some third person is carried out. The grounds for arising of representative relations are determined and systematized. A circle of individuals participating in representative relations is ascertained, their legal characteristics are given. The representative peculiarities according to law in range their characteristic features are examined. The difference between a legal person’s agency and his representative from the position of civil law science is elucidated. The specificity of stipulated representation and such its variety as commercial representation are analyzed. The legal nature of warrant as universal form of authorization with stipulated representation is investigated. On the basis of the performed in the thesis researches some conclusions and proposals concerning improvement of civil legal standards regulatingrepresentative relations are made.
