Kashtanov A. Legal protection from anticompetitive actions in economic competition

Object of research: anticompetitive actions in an economic competition and means of legal protection from them. The purpose of research is the development of theoretical and practical aspects of legal protection from anticompetitive actions in an economic competition and preparation of the offers on perfection of the economic legislation of Ukraine. Methods of research: dialectic, legal, formal-logic, system-structural. Theoretical importance: the level of theoretical development of the given problem in a science of the economic law on perfection of legal protection from anticompetitive actions in an economic competition is considerably increased. Practical importance: the received results of research can be a basis at definition of ways of perfection of the legislation of Ukraine about protection against anticompetitive actions in an economic competition. The applied character of research allows to use its results in practice, in particular of bodies of Antiexclusive committee of Ukraine; in development of measures of legal protection of activity LLC „Ghuravlivske HPP" from anticompetitive actions of the enterprises - competitors, at introduction of system of legal maintenance of economic activity joint-stock company „Selena". The conclusions of work are used in educational process at teaching discipline „the Enterprise law". Scientific novelty: the definition of anticompetitive actions in an economic competition is formulated. The anticompetitive coordinated actions of the subjects of managing are determined and their features are revealed. The classification of the anticompetitive coordinated actions of the subjects of managing is carried out. The interdiction of the anticompetitive coordinated actions and exceptions of it is investigated. The specificity of anticompetitive actions of bodies of authority, local self-management, administrative management and control is established, and also their kinds are revealed. The procedure of the control behind the coordinated actions of the subjects of managing is investigated. The features of proving are revealed at disposal of legal proceeding about anticompetitive actions. The measures of the legal responsibility behind fulfillment of anticompetitive actions are systematized. The offers on perfection of legal protection from anticompetitive actions in an economic competition in Ukraine are proved. Sphere of use are the subjects of the legislative initiative; bodies of Antiexclusive committee of Ukraine; economic courts at disposal of legal proceeding connected to application of the legislation on protection of an economic competition; higher educational establishments.
