Bykova O. The contracting of a marriage and divorce under the legislation of Ukraine

After the adoption of the Family code in Ukraine the thesis the first scientific monograph research devoted to the complex analysis of problem of legal regulation of contracting of a marriage and divorce. The thesis contains investigation of theoretical and practical problems connected with regulation of contracting of a marriage and divorce. The author of the thesis discovers the legal nature of the conditions and the order of contracting of a marriage, the peculiarities of legal regulation of an engagement, problems of annulment of marriage ineffectual or mull and void, annulment of marriage by the state organ of registration of civil status or by the decree of a court. The author has made the scientific conclusions and proposals concerning the improvement of family legislation in force regulates the questions of marriage and divorce. In particular the author proposes to make improvement in the Family Code of Ukraine, Code of Trade Navigation, the Law of Ukraine «On the organs of registration of civil status». On the basis of theoretic achievements of scientists from various countries in different historic periods and analysis of the legislation in the field of legal regulation of contracting a marriage and other normative acts the author substantiates the necessity of the adoption of the Law of Ukraine «On the aces of civil status».
