Shimanovich O. Court decisions in the civil procedure of Ukraine (on the material of resolutions and decisions of the court of first instance).

The thesis deals with research problems of modern and perspective development of the institute of court decisions in civil procedure. In the thesis to be analysed the notion and types of the court decisions, to be revealed content and requirements to the court decisions. The author defines the notion and significance of legal force of court decision and analyses legal effect. The peculiarities of elimination of the gaps in court decision are researched in the thesis. The author defines the notion and essence of court resolution and classifies decisions of the court of first instance. Some theoretical conclusions on the researched questions and practical advises aimed at the improvement of the institute of court decisions in civil procedure are formulated. The author grounds the necessity of addition the list of the reasons for repeal court decisions, the expediency of limitation the term for pronouncement of the additional decisions, and also the necessity of using the procedure of the sending copies of the court resolutions to persons, who took part in the case.
