Prymak V. Civil responsibility of legal entities

The analysis of interrelation and interdependence of legal entity’s structural features, elements of its legal personality and civil responsibility has been carried out. The necessity of guilt withdrawal from the conditions of responsibility for civil offences committed while conducting economic activity has been reasoned. Proposals with regard to taking into consideration the contents of economic and organizational control relations for the introduction of secondary and joint and several liability of the controlling legal entities have been made. Conclusions about the necessity of establishing for all the legal entities, which are owners of property assigned to them, of legal provisions concerning the creation of specialized property funds intended to secure the claims of their creditors, have been made.
