Denchuk R. Administrative and legal protection of communal property

The dissertation is dedicated to investigation of administrative - and - legal protection of communal property. The organizational and administrative - enforcement measures, applied in this sphere, have been characterized in the work. Legal status of the local self-government bodies as the subjects of communal property management has been studied. The conclusion has been made, that the community's property management is a system, in which the property of communal ownership is the object, while the local self -government bodies are the subject. Administrative and legal regulation of organizing the direct physical protection of communal ownership property has been elucidated. Proceeding from the analysis of power relations of the state protection service, it has been suggested to exclude the right for security organizations licensing from the competence of the given governmental service management body. A suggestion concerning the procedure of free property transfer from one ownership form to another hasbeen substantiated and formulated. The communal property relations have been classified into respective groups, depending on the peculiarities of the objects of this kind of property, connected with the capabilities of meeting the interests of the territorial community, identity of the interests of communities at district and regional levels, the interests of people, living in a respective microdistrict, and the respective forms of its administrative - and - legal protection have been suggested on this basis.
