Sukmanova E. Economic contract of providing of consultation services

Object of research: the relations connected to granting of consulting services in sphere of economic activity. The purpose of research consists in development of the recommendations on perfection of the legislation and practice its application in sphere of regulation of the relations on granting consulting services on the basis of the complex analysis of specific features of the economic contract about granting consulting services, about its conclusion and performance. A method of research: logic, dialectic, synthetic, historical, structural, comparative-legal, logic-legal. The theoretical importance consists in a deepening and perfection of theoretical development concerning definition of concept of consulting service and economic contract about granting consulting services, about its conclusion and performance, and also concerning granting consulting services. The practical importance is, that the conclusions and offers, which contain in the dissertation, can be used for improvement of the current legislation, and also in practice of the conclusion and performance of the economic contracts about granting consulting services; were used by preparation and conclusion of the contracts on granting of legal services, contracts on constant legal service (LTD "Elite Consulting"), and also during preparation and conclusion of the contracts on granting of information-consulting services at organization and realization of seminars (LTD "the Center of the economic-legal initiatives"). The scientific novelty is defined by that in the dissertation the concepts and important conditions of the economic contract in sphere of granting of consulting services are complexly investigated; Have received the further development scientific rules concerning application of the possible forms and kinds of the economic responsibility for default or for inadequate performance of the present contract. The perfection of legislative maintenance of development and functioning of the relations on granting consulting services is offered.The definition of such service and economic contract about granting consulting services is given. The differences of the economic contract about granting consulting services from other kinds of the economic contracts are determined. The offers concerning additions of the Commercial code of Ukraine are formulated with the purpose of improvement of legal regulation of granting of consulting services. Sphere of use are the subjects of the legislative initiative, subjects of managing during realization of activity on granting consulting services; commercial courts; higher educational institutions.
