Kikot G. Legal facts in the system of legal relationships

The dissertation is devoted to the issues of methodology, legal theory and practice related to the legal facts in the system of legal relationships. This paper determines general characteristics of the legal relationships, the notions and types of the legal facts, their place in the mechanics of the legal regulation. The dissertation examines the practical aspects of the legal facts, rules for the ascertaining, proving and fixing the legal facts. The work develops the notion of the legal facts systematics and determines the role function of the legal facts in the mechanics of the legal regulation of the leading branches of law. The dissertation contains recommendations for application of basic provisions of the issues considered. The Author worked out the system conception of juridical fact, the functions of these facts in basic branches. It was made a conclusion that the system of juridical facts depends on the character of legal relation, activity of public authorities, law enforcement activity. Reality needs improvement of the ascertainment of facts, their fixation on basis of systems analysis. This process should be based on in-depth analysis of legal relation, social functions of people in dynamics, which produce juridical facts.
