Essay

The dissertation is devoted to analysis of the legal grounds of a rising of obligations in roman private law and modern Ukrainian civil legislation. The author investigates in thirst and second section of dissertation the literature on the theme of dissertation and formulates the methods of research. The third section of dissertation is devoted to a research of genesis and characteristic features of the Roman law system of obligations. A detailed analysis of the delicts, contracts and others legal grounds of a rising of obligations in Roman private law has been presented. In the last section of dissertation the singularity of legal grounds of a rising of obligations in modern Ukrainian civil law are examined. A detailed analysis of the influence of Roman Law on the legal grounds of a rising of obligations has been showed. The conclusions about necessity of reception in the Civil Code of Ukraine of the fundamental tenets of Roman law of obligations, such as divisions of contract on consensual andreal, innominal and so on, and appropriate propositions are made.
