Stefanchuk M. The Limits of the Subject Civil Rights Realization

The thesis is devoted to the investigation of the actual subject civil rights realization problems, definition of their limits and scopes, and the analysis of the abuse by the rights as a civil-law category. The legal nature of the subject civil rights as legal category is investigated, distinction of other adjacent legal categories is established, concept, principles and limits of subject civil rights realization are determined in the thesis. The huge attention in dissertational research is given to questions of definition of essence of subject civil rights abusing, its attributes and forms. The historical aspect of this legal institute is separately considered. Danger of chicane as one of right abuse forms is emphasized; ways of protection against negative influence of abusing by the right is investigated in the thesis simultaneously. Some ways directed on improvement of the legislation is stated in the thesis.
