Soldatenko E. Pretrial investigation in Ukraine: formation and trends of development

Об'єкт дослідження -criminal procedure relations arising during activity of bodies of pre-trial investigation. Мета дисертації - definition of essence both value of pre-trial investigation and bodies, which realize it, in the modern criminal trial of Ukraine, and also search of efficient ways to makes of domestic system of pre-trial investigation in conformity to the Constitution of Ukraine and International-legal standards. Методи дослідження - historical-legal; a method of the system analysis; law-legal; statistical. Наукова новизна - the preconditions of rise of a modern type of domestic pre-trial investigation for the first time are systematized; the ways of gradual reforming of pre-trial investigation to independent branch of law-enforcement activity are defined; the expediency of formation in Ukraine of the investigatory device in system executive, instead of judicial authority is argued; the concrete offers concerning improvement of the acting criminal procedure legislation and draft CPC of Ukraine are formulated. Практичне значення - the results can be used: in research activity - for the further researches in this branch; in law of activity - for improvement acting CPC of Ukraine and preparation of the Draft CPC of Ukraine in a part of activity of bodies of pre-trial inquest; in practical activity - with the purpose of raise of efficiency of activity of bodies of pre-trial investigation; in educational process - during study of the appropriate sections of the criminal procedure, general theory both history of the state and law, and also by preparation of the educational and methodical grants. Предмет і ступінь впровадження - the materials of the dissertation are used during teaching disciplines "the criminal Procedure of Ukraine", "Judicial and law-enforcement agencies of Ukraine" in the Zaporozhye juristic institution MIA of Ukraine, in professional training and improvement of professional skill of the inspectors MIA of Ukraine and by preparation of the Draft CPC of Ukraine. Ефективність впровадження - conclusions and the offers have received a positive rating of the experts. Сфера використання - legislative and educational processes, practical activity of bodies of pre-trial investigation of Ukraine.
